Federal Judge Dismisses All Charges in Blackwater Shooting

A federal judge on Thursday threw out charges against five Blackwater Worldwide security guards accused of killing 14 people in a 2007 shooting in downtown Baghdad.
In a 90-page opinion, U.S. District Judge Ricardo M. Urbina ruled that the government violated the guards' rights by using their immunized statements to help the investigation. The ruling comes after a lengthy set of hearings that examined whether federal prosecutors and agents improperly used such statements that the guards gave to State Department investigators following the shooting on Sept. 16, 2007."

The explanations offered by prosecutors and investigators in an attempt to justify their actions and persuade the court that they did not use the defendants' compelled testimony were all too often contradictory, unbelievable and lacking in credibility," Urbina wrote. Dean Boyd, a spokesman for the Justice Department, said, "We're obviously disappointed by the decision. We're still in the process of reviewing the opinion and considering our options."
Blackwater, which has since renamed itself Xe, had a contract to provide security for the State Department in Iraq.

President Obama and his family are at Windward Mall this morning for a private viewing of the film "Avatar." A media pool report from Peter Baker of the New York Times said the first family left their vacation compound in Kailua shortly after 9.

The special screening of the digital 3-D version of "Avatar" was arranged before the first regular showing to minimize disruption for other moviegoers. One of the mall's nine theaters was reserved for the first family, but the rest are open to the public. Some stores are open, including Borders, where the media pool is waiting. This afternoon, on arguably one of the slower news day of the year, the Obama White House released another document dump of “visitor records.” According to the White House, today’s batch total more than 25,000 records, covering meetings between September 16-September 30th.

According to the visitor logs, on September 2nd Bertha E. Lewis made an appointment on to visit the White House on September 5th at 12:30. (We usually need to plan further ahead to get our hair cut.) On the evening of the 4th, that appointment was cancelled so Bertha could move her appointment earlier, to 10am.

And it doesn’t seem to have actually been a work visit, as her appointment indicates she was visiting the Residence within the White House. Also, September 5th was a Saturday. Nice. In addition, the record notes that she was to receive a STAFF TOUR, which are different-and more special-than the regular Group Tours available to others.

Ms. Lewis doesn’t seem to have returned to the White House after this visit. Of course, just 5 days after this visit, James O’Keefe would release the first video of his undercover journalism on the systemic corruption within ACORN.
This is actually a promise kept, Obama in 2007 told ACORN and other community agitators that they would be invited into the White House to shape the agenda

KABUL – The Taliban claimed responsibility Thursday for infiltrating a CIA base with a suicide bomber who got into a gym and set off an explosion that killed eight Americans and an Afghan. CIA employees were believed to be among the victims. Wednesday's assault on U.S. Forward Operating Base Chapman at the edge of Khost city in eastern Afghanistan was a blow to the CIA, which had previously lost only four operatives in this country since the Sept. 11, 2001 attacks.

It came on a bloody day for NATO forces. A roadside bombing, also claimed by the Taliban, killed four Canadian troops and a Canadian journalist in southern Afghanistan. Elsewhere, police said militants beheaded six Afghans on Thursday for cooperating with government authorities.
Also Thursday, the United Nations said a preliminary investigation showed that a raid last weekend by foreign troops in a tense eastern Afghan province killed eight students. The attack sparked protests by Afghans against foreign troops.

Rasmussen: 29% Say America is on the Right Track, 67% Wrong Track

67% say America is on the wrong track, the highest of the Obama Presidency

For the second straight week, only 29% of U.S. voters say the country is heading in the right direction, according to the latest Rasmussen Reports national telephone survey. Last week’s right direction finding was the lowest level measured since February.

The percentage of voters who felt the country is heading in the right direction remained in the narrow range of 31% to 35% from July to early November. From late November until mid-December, confidence in the country’s current course held steady at 30%.

The majority of voters (67%) continue to believe the nation is heading down the wrong track, the highest level found in 2009. However, in the weeks just prior to Barack Obama's election, more than 80% of voters felt that way.

Limbaugh suffered from chest pains, sources said. Paramedics treated him and took him to Queen's Medical Center in serious condition.

The radio show host had been in the islands during the holidays. Coincidentally, his visit comes at a time when two of the nation's most powerful Democrats, President Barack Obama and House Speaker Nancy Pelosi, are also staying in Hawaii.

THE BLAME GAME: White House communications director Dan Pfeiffer responds to Dick Cheney's criticism of President Obama, saying that the former vice president is "more focused on criticizing the Administration than condemning the attackers."

"To put it simply: this President is not interested in bellicose rhetoric, he is focused on action," Pfeiffer wrote on the White House blog. "Seven years of bellicose rhetoric failed to reduce the threat from al Qaeda and succeeded in dividing this country. And it seems strangely off-key now, at a time when our country is under attack, for the architect of those policies to be attacking the President."

Cheney had told POLITICO that Obama was "trying to pretend we are not at war." Pfeiffer called the claim "clearly untrue."

Former Vice President Dick Cheney accused President Barack Obama on Tuesday of “trying to pretend we are not at war” with terrorists, pointing to the White House response to the attempted sky bombing as reflecting a pattern that includes banishing the term “war on terror” and attempting to close the Guantanamo Bay detention center.

“[W]e are at war and when President Obama pretends we aren’t, it makes us less safe,” Cheney said in a statement to POLITICO. “Why doesn’t he want to admit we’re at war? It doesn’t fit with the view of the world he brought with him to the Oval Office. President Barack Obama and his family spent a few hours at Hanauma Bay on a day that the popular destination sight is closed to the public.

The president's motorcade drove him to the nature preserve early this afternoon after he delivered a statement about the "systemic failure" that allowed an attempted Christmas Day attack on a Detroit-bound flight from Amsterdam.

The first family and some friends had a picnic and snorkeled
at one of Oahu's top visitor destinations.

Hanauma Bay is closed to the public on Tuesdays to allow the coral reef to recover from intense visitor use during the rest of the week. So the Obama entourage had the beach to themselves.

The good news for Senator Ben Nelson is that he doesn’t have to face Nebraska voters until 2012. If Governor Dave Heineman challenges Nelson for the Senate job, a new Rasmussen Reports telephone survey shows the Republican would get 61% of the vote while Nelson would get just 30%. Nelson was reelected to a second Senate term in 2006 with 64% of the vote. Nelson's health care vote is clearly dragging his numbers down.

Just 17% of Nebraska voters approve of the deal their senator made on Medicaid in exchange for his vote in support of the plan. Overall, 64% oppose the health care legislation, including 53% who are Strongly Opposed. In Nebraska, opposition is even stronger than it is nationally Fifty-six percent (56%) of voters in the state believe that passage of the legislation will hurt the quality of care, and 62% say it will raise costs.
